Supreme Court Dismisses Justice Yashwant Varma’s Plea Challenging CJI’s Recommendation for Removal

The Supreme Court of India recently dismissed the petition filed by Justice Yashwant Varma of the Allahabad High Court, who challenged the Chief Justice of India's (CJI) recommendation for his removal. This recommendation followed the discovery of a large amount of unaccounted cash at his official residence. At Mujib Law Associates, our experienced Divorce lawyers, family law specialists, and property dispute advocates in Tambaram recognize this ruling as a strong affirmation of judicial accountability and the importance of upholding the integrity of the legal system.

Justice Varma initially cooperated with the in-house inquiry but later raised objections after the findings became unfavorable. The Supreme Court bench, led by Justices Dipankar Datta and A.G. Masih, emphasized that one cannot accept the authority of an inquiry and then later question its legitimacy when the outcome is adverse. This highlights the importance of procedural fairness and respect for in-house judicial mechanisms designed to maintain discipline within the judiciary.

The Court upheld that the in-house inquiry conducted by the CJI and the committee was constitutional and followed proper procedures. Allegations questioning the validity of the inquiry and claims of irregularities were dismissed. The Court noted that even the sharing of photos and videos related to the investigation did not affect the inquiry's legality, reinforcing trust in these internal accountability processes.

Justice Varma contended that he should have been granted a hearing before the inquiry report was submitted to the President and Prime Minister for further action. However, the Supreme Court clarified that such a hearing is not a procedural necessity. The CJI holds a distinct constitutional role—not merely as a conduit but as a guardian of judicial integrity with the authority to recommend removal based on inquiry findings.

The controversy began in March 2025, when a fire at Justice Varma’s official residence led to the discovery of a considerable cache of cash. This incident triggered a three-member committee’s formation by then CJI Sanjiv Khanna to investigate. The inquiry’s critical findings became the basis for recommending Justice Varma's removal, highlighting the judiciary’s commitment to self-regulation and probity.

The Supreme Court examined six key legal issues surrounding the in-house inquiry’s constitutionality and procedural aspects. It reaffirmed that these inquiries operate within constitutional limits and are not parallel or extraconstitutional mechanisms. Importantly, Justice Varma retains the right to defend himself in any impeachment proceedings before Parliament, preserving his legal rights as the process advances.
